or injure you. SingleinTO.com is not responsible for the use of any

that are not readily accessible to the general public will be treated
as private by SingleinTO.com to the extent required by applicable law
and pursuant to the commercially reasonable efforts of SingleinTO.com.
PROPRIETARY RIGHTS
SingleinTO.com owns and retains proprietary rights to
its Services and its Site(s). Even if this Agreement between Member
and SingleinTO.com is terminated for any reason, SingleinTO.com will
continue to own Member’s information, including demographic information,
photos and information/content posted on Member’s profile. SingleinTO.com
may aggregate Member’s profile with other profiles from other
SingleinTO.com Site(s). The Services and the Site contain the copyrighted
material, trademarks and other proprietary information and software
of SingleinTO.com and its licensees. In addition, other Members may
post copyrighted information, which has copyright protection whether
or not it is identified as copyrighted. Except for that information
which is in the public domain or for which you have been given permission,
you will not copy, modify, publish, transmit, distribute, perform, display
or sell any such proprietary information.
By posting information or content to any area of SingleinTO.com,
you automatically grant, and you represent and warrant that you have
the right to grant, to SingleinTO.com and other Members an irrevocable,
perpetual, non-exclusive, fully-paid, worldwide license to use, copy,
perform, display and distribute such information and content and to
prepare derivative works of, or incorporate into other works, such information
and content, and to grant and authorize sublicenses of the foregoing.
INFORMATION SUPPLIED BY MEMBER
SingleinTO.com will respect your personal information
and undertake to comply with all applicable data protection legislation
in Ontario and other jurisdictions in which it offers its Service,
subject to the Privacy Policy of SingleinTO.com. The personal information
(including sensitive personal information) you provide to SingleinTO.com
will be stored on computer. You consent to SingleinTO.com to use this
information to build up a profile of interests, preferences and browsing
patterns and to allow you to participate in the SingleinTO.com Service.
All Members also agree to uphold and maintain the Privacy Policy of
SingleinTO.com and to the terms and conditions thereof. You may read

DISCLAIMER OF WARRANTY
SingleinTO.com provides the Service and the site on an
"As Is" basis and grants no warranties of any kind, express,
implied or statutory, in any communication with SingleinTO.com or its
representatives, or otherwise with respect to its Service and its Site(s).
SingleinTO.com specifically disclaims any implied warranties of merchantability,
fitness for a particular purpose or noninfringement. SingleinTO.com
does not warrant that your use of the Service or the Site will be secure,
uninterrupted, always available or error-free, or will meet your requirements
or that any defects in the Service or the Site will be corrected. SingleinTO.com
disclaims liability and no warranty is made with respect to use of this
Service, including any interruptions of Service, viruses, power outages
or communications by other Service users.
LIMITATIONS OF LIABILITY
In no event shall SingleinTO.com be liable to you for
any incidental and consequential damages, including but not limited
to, damages for loss of data, loss of programs, cost of procurement
for substitute services or service interruptions, arising out of the
use of or inability to use the Service or the Site, even if SingleinTO.com
or its agent or representative know or have been advised of the possibility
of such damages, or to any person other than you. Notwithstanding any
contrary provision herein but subject to the foregoing limitation, in
all events the liability of SingleinTO.com to you for any cause whatsoever,
regardless of the form of the action, will at all times be limited to
the amount paid, if any, by you or a third party to SingleinTO.com for
the Service during the term of your membership. SingleinTO.com disclaims
all liability, regardless of the form of action, for the acts or omissions
of other Members or users (including unauthorized users, or "hackers")
of the Service.
TERMS OF AGREEMENT
SingleinTO.com is a service for adults only and you agree
that you are at least 18 years of age. If you chose not to accept the
terms of this Agreement, you must terminate your participation before
using the Service. By registering and participating in SingleinTO.com, you attest
that you are at least 18 years of age and you agree to abide by the
following rules:
- You are the publisher of your content and are solely responsible for
the information that you post and for your interaction with other users
of this service.
- You will not harass others or use any vulgar, racist, or otherwise offensive
language, either in public posted material, voicemail messages, video-chat
or in private E-mails sent to other users of this service.
- You will not post any last names, telephone numbers, street addresses,
URL's and/or E-mail addresses in your profile.
- You will not post any photos containing nudity.
- You will not post any photos containing personal information.
- You will not forward chain letters or post advertisements.
- You will not use any service provided by SingleinTO.com to defame, libel,
slander, harass and bother any person.
- You will not use this service or any service provided by SingleinTO.com
to infringe the privacy rights of any person.
- You will not include in your profile any sexually suggestive and connotative
language or anatomical or sexual references.
- You will not post any information that infringes the property rights
of any person, including but not limited to the intellectual property
rights of any person.
- You will not forward E-mails and other information without permission
of the originator of the information.
- You will not copy, modify, distribute, or sell any proprietary information
of SingleinTO.com and its licensors.
- You will not copy, modify, distribute, or sell any copyrighted information
which has copyright protection whether or not it is identified as copyrighted,
except for that information which is in the public domain or for which
you have been given permission.
- You assume full responsibility for all charges from other providers
incurred in accessing the SingleinTO.com Service (such as online access
providers, telephone service providers, or others).
- You may terminate your membership in the service for any reason.
- SingleinTO.com does not verify any information posted to the service
(excluding 'Verified Photos').
- SingleinTO.com does not guarantee the proper use of such information
by any party.
- SingleinTO.com does not review or assume any responsibility for the
content of private E-mail messages sent between users of this service.
- SingleinTO.com does not ensure that these messages may not contain material
that could be offensive to some.
- SingleinTO.com does not monitor or resolve disputes between users of
this service.
- SingleinTO.com does not ensure that offensive material will be promptly
removed from the service.
- SingleinTO.com does not ensure secure transmissions over the Internet.
- SingleinTO.com reserves the right to edit photo submissions.
- SingleinTO.com reserves the right to prohibit offensive language from
the public areas of the service.
- SingleinTO.com reserves the right but shall have no obligation to remove
materials from the service that are not in compliance with this Service
Agreement or the rules of SingleinTO.com.
- SingleinTO.com reserves the right to terminate your membership in the
service for any reason.
- SingleinTO.com reserves the right to terminate service without notice
to any user who fails to comply with this Service Agreement or the rules
of SingleinTO.com.
- SingleinTO.com reserves the right to monitor the public areas of the
service in accordance with any legal requirement, in order to maintain
the service, and to protect the rights of service users.
- SingleinTO.com is not responsible for the use of any personal information
that you may choose to disclose on this service.
- SingleinTO.com is the billing entity and your billing statements will
reflect such.
- All sales are final.
INDEMNITY
You agree to defend, indemnify, and hold harmless SingleinTO.com,
its officers, directors, employees, agents, independent contractors
and third parties, from your use of the Service, including any violation
of the rules contained in this Agreement or any accusation that the
information that you post infringes the intellectual property rights
(such as copyright, trade secret, trademark, or patent) of any third
party or that such information disparages, libels or invades the privacy
of any third party.
